Tomatina Gift Card Terms & Conditions
All Tomatina gift cards (“Gift Cards”) are final sale and non‑refundable, and may not be redeemed for cash except where required by applicable law. In accordance with California Civil Code §1749.5 and other applicable law, Gift Cards do not expire, carry no dormancy or service fees, and, where required by law, may be redeemed for their unused cash value when the remaining balance is below the statutory threshold.
Gift Cards are valid only at participating Tomatina locations and must be presented at the time of purchase. Gift Cards will not be replaced if lost, stolen, damaged, or used without authorization. Use of a Gift Card constitutes acceptance of these terms and conditions.
Limitation of Liability. To the fullest extent permitted by applicable law, Tomatina’s liability for any claim arising out of or related to a Gift Card is limited to the lesser of (a) the remaining balance on the Gift Card and (b) the original purchase price paid for the Gift Card. Except where prohibited by law, Tomatina will not be liable for any indirect, incidental, special, punitive, exemplary, or consequential damages, including loss of profits, loss of data, or loss of goodwill.
Exceptions. The foregoing limitations and exclusions do not apply to (a) liability for willful misconduct, gross negligence, or fraud, (b) liability that cannot be limited or excluded by applicable law, or (c) statutorily required consumer rights, including cash redemption where required by law.
Changes and Severability. Tomatina may modify these Gift Card terms and conditions from time to time to the extent permitted by law; material changes will be posted or otherwise communicated in accordance with applicable law. If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
